Sec. 9-1.3. Amendments to the California Building Code Appendix.

The amendments to the California Building Code Appendix are as follows:

(a) Appendix Chapter 33, entitled "Excavation and Grading," is amended in its entirety to read as follows:

Appendix Chapter 33, Excavation and Grading.

Section 3301 -- PURPOSE

The purpose of this Chapter is to safeguard health, safety and the public welfare; to protect fish and wild life and riparian corridors and habitats, domestic and industrial water supplies, private and public property, and to otherwise protect the natural environment from the effects of flooding, accelerated erosion and/or siltation by establishing minimum standards for excavations, cuts, fills, clearing, earthmoving, grading, erosion, and sediment controls.

Section 3302 -- ADOPTION OF STANDARDS

(a) To implement this Chapter, the City Engineer shall develop and maintain standards for excavations, cuts, fills, clearing, earthmoving, grading and erosion and sediment control which standards shall take effect upon adoption by resolution of the City Council.

Section 3303 -- PERMIT
APPLICATION REQUIREMENTS AND APPROVAL

Except as exempted in standards established in Section 3302 of this Chapter, no person shall do, cause, aid, abet, suffer or furnish equipment or labor for any excavations, filling, clearing, grading, or erosion control work unless a permit has been obtained from the City by the owner(s) of the property (or agent when authorized in writing) for each site. A permit shall authorize only that work which is described or illustrated on the plans and specifications submitted and approved in accordance with standards established and adopted by resolution of the City Council pursuant to Section 3302.

Section 3304 -- FEES

Fees for plan checking, variances, permits, and/or other services shall be as set forth in Tables 3-G and 3-H of Resolution Number 18138 adopted by the Salinas City Council on January 14, 2003 (or by succeeding resolution).
Section 3305 -- VIOLATIONS AND ENFORCEMENT

All violations of this Chapter including violations of the standards established and adopted by resolution pursuant to the authority granted by this Chapter shall constitute a violation of Section 103 of the California Building Code, and shall be enforced in accordance with Section 1-7 of the Salinas City Code.

Section 3306 -- PARKING AREAS

Parking areas constructed in conjunction with commercial and industrial developments shall have adequate drainage facilities to dispose of surface water offsite. Storm water shall be conveyed under sidewalks to street gutters and/or storm sewers, in approved conduit, if the water is collected from an area exceeding one acre, or if sheet runoff over the public way is collected from a lot depth in excess of 400 feet from the sidewalk.
