Sec. 9-50.80.1. Credits and exemptions.
(a) Any new construction of enclosed building space which
replaces a demolished building shall be exempt from traffic impact fees to the
extent of the square footage and prior use of the demolished building if
demolition occurred within five years of the date of application for building
permit for new construction.
(b) When a change in use occurs for an existing enclosed
building, credit for prior use of that building shall be allowed if that prior
use has been discontinued for not more than three years from initiation of new
use.
(c) The property owner of building permit applicant shall have
the burden of providing adequate documentation to support a claim of credits or
exemptions under subsections (a) and (b) herein. The determination of the public
works director shall be final. (Ord. No. 2156 § 1.)
