CHAPTER 9. BUILDINGS.*
Sec. 9-6.4. Order of the city council.
If, from a full and fair consideration of the evidence and
testimony received at the hearing, the city council shall determine that a
building or structure, or any portion thereof, is unsafe and a public nuisance,
then it shall overrule the appeal and issue an order certified by the city
clerk;
(a) That the building or structure shall be repaired; or,
vacated and repaired; or, demolished;
(b) That the occupant, lessee or other person in possession
shall vacate the building or structure, or that he may remain in possession
while repairs are being made;
(c) That any mortgagee, beneficiary under a deed of trust or
any other person having an interest or estate in the building or structure may,
at his own risk, repair, vacate and repair or demolish it.
The order shall set forth the information required in Section
401.2, subsections 1 through and including 5, of the Uniform Code for the
Abatement of Dangerous Buildings. (Ord. No. 2276 (NCS), § 8(F).)
